Thank you for agreeing that the Child, for whom you hold parental responsibility, may contribute to the Programme. By signing this form you agree to the following terms:
In consideration of £1 (one pound sterling) and our mutual exchange of obligations (which you acknowledge to be good and valuable consideration):
1. You acknowledge the nature and purpose of the Child’s Contribution has been explained to you.
2. You agree to the recording and/or broadcasting of the Child’s Contribution and assign to us all rights in the Contribution for us to use it worldwide in perpetuity in all media known now or in the future.
3. To the best of your knowledge and belief, the Child’s Contribution will not infringe the copyright or any other rights of any third party or be defamatory.
4. We may edit, copy, adapt or translate the Child’s Contribution at our discretion and you waive any “moral rights” that may exist in the Contribution.
5. We may use any photographs, materials and/or recordings (“Content”) provided by you in the Programme for the uses set out in the Contribution. You confirm you own and/or control the rights to allow us to use the Content in all media, worldwide and in perpetuity without any further payment due.
6. I agree to the taking of still photographs of my child for publicity purposes (if required) and the Company may without my further consent use the Contributor’s name, likeness, biography, photographs and recordings of interviews with the Contributor in advertising, publicising, promoting the Content in all media formats throughout the world.
7. I warrant to the Company, to the best of my knowledge, the Contribution provided by the Contributor is truthful, genuine, does not infringe any copyright and data protection laws, and is not a breach of confidence, defamatory, libellous, constitute a contempt of court, an act(s) that shall bring the Company or broadcaster into disrepute or an act in contravention of the Official Secrets Act.
8. I warrant and agree that the Contributor and I shall not either personally or by other means make any statement or disclose any confidential information or methods of production to any third party or any media related organisation relating to the Content, or the general affairs of the Company and/or broadcaster in connection with the recording of the Contribution, unless there is a prior written consent from the Company.
9. We will not be liable for any loss or damage to you, the Child or your property unless caused directly by our negligence.
10. Although we hope to use the Child’s Contribution, we cannot guarantee to do so.
11. UK broadcasters and Creative Diversity Network (CDN) are monitoring diversity on UK television through Diamond. We have a legitimate interest to collect diversity information about our industry and if you provide us with your name and email address, we will enter this into a system called Silvermouse and you will be invited to provide the diversity characteristics of the Child. The broadcasters and CDN, as data controllers, are responsible for this data and will retain your name and email address for this purpose in Silvermouse for as long as diversity is monitored by them. 12. You hereby irrevocably and in perpetuity grant to us throughout the world the right to authorise and to authorise others to issue publicity concerning the services of the Child in connection with the Programme and to use the name, voice, biography and likeness of the Child in connection with the exploitation of the Programme in all media and/or the advertising, publicising and/or promotion of the Programme and/or the financiers and/or the distributors of the Programme but so that, without your prior written consent, such use shall not suggest that the Child endorse, recommend or use any commercial products or services other than the Programme and/or the said financiers and/or distributors.
13. We will collect and process personal data of the Child you provide us with for the purpose of (i) the performance of this contract, or (ii) fulfilling our contractual obligations to the broadcaster, where we have balanced those obligations against your rights, freedoms or interests and those of the Child. Any Special Category personal data you provide will be processed for the purposes of producing journalistic or artistic content for publication by the broadcaster in the public interest. 14. This Agreement is governed by the laws of England and Wales and the jurisdiction of the English and Welsh courts applies.
